Will of Kirby Francis 1783 - 1843

Kirby Francis was the eldest sibling of my 4g-grandfather, George Francis. This Will is derived from a Copy book.



This is the last Will and Testament of me Kirby Francis of the City of Canterbury Plumber, Painter and Glazier whereby I give devise and bequest all the real and personal property of whatsoever description I may die possessed of, after and subject to the payment therefrom of all my just debts funeral testamentary and other Expences (sic) and to the payment also at the end of twelve Calendar months from my death of the two following Legacies, namely

to each of my two sisters Jane Highsted Widow and Ann the wife of John Nickolls the sum of Nineteen pounds and nineteen shillings and unto my Brother George Francis his heirs executors administrators and assigns absolutely [*...*] and I appoint him my said brother sole executor of this my Will and hereby revokeing (sic) all former and other wills by me made, I declare this only to be my last, as witness my hand this the first day of February one thousand eight hundred and forty two.

In the Archdeacon’s court of Canterbury – In the goods of Kirby Francis deceased.

Appeared personally Edward Austen of St Stephens near Canterbury in the county of Kent Victualler and made Oath that he is one of the subscribed witnesses to the last will and testament of Kirby Francis late of the city of Canterbury plumber painter and glazier deceased bearing date the first day of February aforesaid.

The said testator duly executed his said will by signing his name at the foot or end thereof in the presence of this deponent and of Thomas Lines and Henry Ovenden (the other subscribed witnesses thereto). All of who were present at the same time and this deponent and the said Thomas Lines and Henry Ovenden thereupon attested and subscribed the said Will in the presence of the said Testator Edward Austen (sic). On the twenty seventh day of September 1843 the said Edward Austen was duly sworn to the Truth hereof.

The before registered Will of Kirby Francis deceased was proven the twenty seventh day of September 1843 before the Revered John Metcalfe Surrogate to the Worshipful Sherrard Beaumont Burnaby Doctor of Laws Office General to the Reverend the Archdeacon of Canterbury lawfully constituted by the Oath of George Francis, Brother of the deceased the sole Executor named in the said Will he being first sworn duly to perform the same.
